Terms of Service

1. Who can use Sunkind

Sunkind is intended for adults and is not directed to children. You must be at least 13 years old to use the app, and if you are under the age of majority where you live, you may only use it with the involvement of a parent or guardian who agrees to these terms. By using Sunkind you confirm you meet these requirements.

2. The service

Sunkind is a tanning and UV-tracking app for iPhone. Features include a UV index and forecast, a skin-type quiz and optional AI skin scan, a silent tan timer, personalized routines, an on-device tan-progress journal, and Apple Health logging. Features and availability may vary by plan, device, and location, and may change over time as we improve the app.

3. Your account

Sunkind uses Sign in with Apple. You are responsible for keeping access to your Apple ID secure and for activity under your account. How we handle your data is described in our Privacy Policy and Consumer Health Data Privacy Policy.

4. Subscriptions, free trial & billing

• Sunkind Pro is offered as Monthly ($7.99/mo), Annual ($39.99/yr), or Lifetime ($79.99 one-time). Current pricing is shown in the app before you buy.
• The Annual plan includes a 7-day free trial for new subscribers. If you don’t cancel at least 24 hours before the trial ends, it converts to a paid annual subscription automatically. Monthly is billed immediately; Lifetime is a single one-time purchase, not a subscription.
• Subscriptions are billed to your Apple ID and renew automatically for the same period unless you cancel at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel anytime in iOS Settings → Apple ID → Subscriptions. Cancelling stops future renewals; it doesn’t retroactively refund the current period.
• Prices may change. We’ll provide notice as required, and material increases to an existing subscription take effect only after your consent where Apple requires it.

5. Refunds

Purchases are processed by Apple, so refunds are handled by Apple under the App Store terms — we cannot issue them directly. To request one, visit reportaproblem.apple.com. Where local law gives you a non-waivable refund or cancellation right, nothing here limits it.

6. Health & assumption of risk

Sunkind provides general information to help you plan time in the sun. It is not medical advice and is not a substitute for professional judgment, diagnosis, or treatment. UV forecasts, timers, skin type estimates, and routines are estimates for personalization, not guarantees — actual conditions and how your skin reacts can differ.

Sun exposure carries real risks, including sunburn, premature skin aging, and long-term skin damage. You are solely responsible for your own choices in the sun.Don’t rely on Sunkind to prevent sunburn or skin damage. If you have any concern about your skin, a mole, or a reaction, talk to a qualified medical professional.

7. Your content

Any tan-progress photos you add to your journal are stored only on your device — we never receive or store them (see the Privacy Policy). You keep all rights to your photos. If you choose to share a photo or comparison from the app, you do so at your own discretion and are responsible for where it goes.

8. Acceptable use

You agree not to:

• reverse-engineer, decompile, or attempt to extract the app’s source code, except where the law permits it;
• interfere with, disrupt, or place undue load on the app or its supporting services;
• access the app through unauthorized means or attempt to bypass security or usage limits (including the skin-scan rate limits);
• use the app unlawfully, or to infringe anyone’s rights.

9. Intellectual property

Sunkind, including its software, content, and branding, is owned by Foxtide LLCand protected by law. We grant you a limited, personal, non-transferable, revocable license to use the app under these terms. These terms don’t grant you any rights to our trademarks.

10. Third-party services

Sunkind relies on third-party services to work — including Apple (Sign in with Apple, WeatherKit, the App Store, push notifications, HealthKit), RevenueCat for subscription management, OpenAI for the optional skin scan, Supabase for data storage, and PostHog for analytics. Your use of those features is also subject to those providers’ terms, and we’re not responsible for third-party services we don’t control.

11. App Store terms

Because you get Sunkind through Apple’s App Store, the following also apply:

• This agreement is between you and Foxtide LLC only, not with Apple. Apple is not responsible for the app or its content.
• Your license to use Sunkind is limited to a non-transferable license to use it on any Apple-branded product you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Foxtide LLC, not Apple, is solely responsible for the app and for providing any maintenance and support — Apple has no obligation to furnish any.
• To the extent permitted by law, Apple provides no warranty for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); otherwise Apple has no other warranty obligation for the app.
• Foxtide LLC, not Apple, is responsible for addressing any claims relating to the app, including product liability, failure to conform to legal or regulatory requirements, consumer protection claims, and intellectual-property claims.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right to enforce them against you.

12. Disclaimers

The app is provided “as is” and “as available”without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the app will be uninterrupted, error-free, or that UV or weather data will be accurate or complete. Some jurisdictions don’t allow certain disclaimers, so some of these may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Foxtide LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the app. To the fullest extent permitted by law, our total liability for any claim relating to the app is limited to the amount you paid us for it in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

14. Indemnification

You agree to indemnify and hold Foxtide LLC harmless from claims and expenses arising out of your misuse of the app or your violation of these terms or applicable law.

15. Termination

You may stop using Sunkind at any time and delete your account in-app (see Delete Your Account). We may suspend or terminate your access if you materially breach these terms or misuse the app. Provisions that by their nature should survive — including ownership, disclaimers, limitation of liability, and indemnification — survive termination.

16. Changes to these terms

We may update these terms. We’ll revise the date above and, for material changes, provide notice as appropriate. Continuing to use the app after an update means you accept the revised terms.

17. Governing law & disputes

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. The courts located in King County, Washington will have jurisdiction over any dispute that isn’t subject to a non-waivable consumer right to bring proceedings elsewhere.

18. Miscellaneous

If any provision of these terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn’t a waiver. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets. These terms, together with our Privacy Policy, are the entire agreement between you and Foxtide LLC regarding the app.
